How Does Florida Amendment 3 Affect PCS Buyers Moving to the Space Coast?
Amendment 3 passed. For PCS buyers moving to Patrick SFB and the Space Coast, residency timing, homestead filing, and the Dec. 31, 2026 cutoff...
Relocation
Short answer: Yes. You can buy a home in Brevard County before your PCS to Patrick Space Force Base, even with a VA loan. VA expects you to move in within 60 days of closing, but a later date tied to your report date can work, generally up to 12 months, and your spouse can meet the occupancy rule if you cannot.
Most people on orders to Patrick want to know two things: can they lock in a house before they get here, and will the VA loan allow it. The rules are more flexible than many buyers expect, as long as the home will be your primary residence and your paperwork lines up with your orders. Here is how it works for a purchase on Florida's Space Coast, including the parts that trip people up.
You do not need orders to get preapproved, but most lenders want them before they will approve a loan on a home near your new duty station.
Your income, credit, and Certificate of Eligibility can all be reviewed early. You can request the certificate through VA's Certificate of Eligibility page or have your lender pull it. What usually waits for orders is the contract itself, because the lender needs to see that the house you are buying lines up with where you will be stationed. If you have a report date for Patrick, ask your lender exactly which documents they need from your orders packet so nothing stalls once you are under contract.
VA treats moving in within 60 days after closing as a reasonable time. A later date can be accepted when you certify a specific move-in date and there is a particular future event that makes that date possible.
The law behind this is 38 U.S.C. 3704(c), which requires you to certify that you intend to occupy the property as your home within a reasonable time. VA's Lenders Handbook (VA Pamphlet 26-7, Chapter 3) spells out the details:
| Situation | What VA guidance says |
|---|---|
| You move in within 60 days of closing | Considered a reasonable time |
| You move in later, on a set date tied to an event such as your report date | Can be considered reasonable if you certify the date and the event |
| Move-in more than 12 months after closing | Generally not considered reasonable |
| You are on active duty and cannot move in, but your spouse can | Spouse occupancy satisfies the requirement |
| You are deployed from your permanent duty station | You are in a temporary duty status and can still meet the requirement |
A PCS report date is the kind of future event that guidance has in mind. If you close in the spring and report to Patrick in late summer, your lender documents the date and the orders, and the file can still work. Your lender makes the final call, so get their answer in writing before you set a closing date.
Yes. If you are on active duty and cannot occupy the home within a reasonable time, your spouse living there, or planning to, satisfies the VA occupancy rule.
This comes up often when one spouse goes ahead to Brevard to start a job or handle the move while the service member finishes up at the current station. The catch is money: VA guidance tells lenders to consider the cost of keeping two households when they underwrite the loan. If you will be paying housing costs at your current station while your spouse is in the Brevard house, expect the lender to count both, which can lower how much house you qualify for.
The biggest risks are buying a home you have only seen on video, missing insurance or flood details, and having orders change after you close.
It can. To get the Florida homestead exemption for a tax year, you must own the home and make it your permanent residence on January 1, then apply by March 1.
That rule comes from Florida Statutes section 196.031 and the March 1 filing deadline in section 196.011. The statute also counts a home that is the permanent residence of someone legally or naturally dependent on you, which matters when a spouse moves in first. If you close in December but nobody moves in until February, you may wait a year for the exemption. Confirm the details for your situation with the Brevard County Property Appraiser before you pick a closing date.
Start with financing and research months ahead, then write offers once you have orders and a report date.

As a Military Relocation Professional and Brevard County Relocation Realtor, most of the PCS buyers I work with are not here yet when we start. What I see go wrong is rarely the VA loan. It is the timing: a closing date that lands too far ahead of the report date, insurance quotes that show up late, or a homestead filing that gets missed because the move-in slipped past January 1. I would rather map those dates out with you and your lender before we write an offer. If buying early does not make sense for your orders, renting first is a fair choice too, and I will tell you so. Often yes. VA allows a move-in later than 60 days when you certify a specific date and a future event, such as your report date, makes it possible. Occupancy more than 12 months after closing is generally not accepted.
Yes. If you are on active duty and cannot move in within a reasonable time, your spouse occupying the home, or intending to, satisfies the requirement, and the spouse signs the occupancy certification.
VA guidance treats a service member deployed from their permanent duty station as being in a temporary duty status, so you can still meet the occupancy requirement even if no spouse lives in the home while you are gone.
Generally yes. The VA occupancy rule applies when you buy, so a later move on new orders does not undo it. Check any HOA or condo rental limits before you buy if you think you will rent it out later.
